Batter Up!

Letter written to the NEW Prosecuting Attorney in Isabella County.

 

Dear Risa Scully,

Members of the Isabella County Sheriff Department conspired together and came to my family’s property in disguise with the intent to deprive my family of rights secured by the constitution of the United States and in violation of federal criminal laws as defined in Title 18 U.S.C. §§ 241 and 242.

Our home and it’s contents were taken from us without any due process of law by police action, under color of law and threat of arrest on September 27, 2010. No receipt, no police report and no court order.

Our every attempt at redress has been blocked and/or denied without any explanation.

Isabella County Sheriff Department employee Shelly Sweet came to our home disguised as a civilian and together with Sheriff Deputy Clinton Steinert forced us to leave our home under threat of arrest without any legal cause of justification.

The same day, your predecessor, Larry Burdick was reported to have said, according to under-sheriff John Tellis, that if we could prove that we had not been evicted that we should get our house back and ultimately we did but not before it was further looted.

Since these events, the administrative staff of the sheriff department have actively participated in the cover-up and concealment of these crimes against us and have made themselves accessories to federal crimes. 

Our Sheriff Department claims that our complaints are civil and I strongly disagree with one exception. That lone exception is that violations of the Anti-Lockout statute as defined in MCL 600.2918. Our unlawful lockout was the only civil component to our claim.

The problem is that the looting of our home started prior to our having discovered that we had been unlawfully locked out of our home. B&E, Criminal Trespass and Grand Larceny all took place when my family was out of town and away from our home.

Additionally, it has been reported to us that Shelly Sweet invited friends and coworkers into our home to have whatever they wanted for free after claiming that we had abandoned a house full of home furnishings, never paid her rent, forcing her into foreclosure and also claimed that we had been trashing the house.

Much much more than probable cause can easily be found in the court records of our civil suit against the county.

I was arrested that same night for calling 911 and your office investigated the criminal charges against me for almost four months after it canceled my arraignment without notice to me. I was forced to remain in Isabella county when I moved my family away for their safety.

With another 8% of the vote I would have been elected sheriff and would have brought this matter to you from that official capacity.

Title 18 U.S.C. § 241
This statute makes it unlawful for two or more persons to conspire to injure, oppress, threaten, or intimidate any person of any state, territory or district in the free exercise or enjoyment of any right or privilege secured to him/her by the Constitution or the laws of the United States, (or because of his/her having exercised the same).

It further makes it unlawful for two or more persons to go in disguise on the highway or on the premises of another with the intent to prevent or hinder his/her free exercise or enjoyment of any rights so secured.

Punishment varies from a fine or imprisonment of up to ten years, or both; and if death results, or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title or imprisoned for any term of years, or for life, or may be sentenced to death.

Our 911 call for help was held for over an hour allowing Sweet to leave work at the sheriff department, go to her home and disguise herself as a civilian and return to our property in that disguise. That same disguise was continued when the lawyer representing the county claimed to be representing the county, the sheriff department, all elected and employed persons named in the action even though he did not represent Sweet. It was his intent to allow me to continue to believe that Sweet was not and employee of the sheriff department.

Sweet and Steinert came onto our property with the specific intent to deprive my family of every right and privilege secured to us by the constitution and laws of the United States.

This criminal conspiracy to deprive my family of our rights and freedoms was then recognized by the administrative staff of the sheriff department as having serious and significant criminal implications that this county could not afford to bare and made my family the sole recipient of this burden by lying to State Police and the media claiming that we were just upset because we had been evicted when we had not.

I have 200+ petition signatures calling for an end to corruption in Isabella County and to see to it that our assailants are held accountable for all of their actions and soon that number will be exponentially higher as my efforts on the internet continue to gain exposure.

Much of what we know now, our sheriff department and it’s staff have known for the past 2.5 years but refused to do anything about because they themselves were implicated and didn’t have the moral character to do the right thing.

Congratulations on your early appointment and for having won the election. I apologize that this nastiness is one of the first thing that you have to deal with but also feel that the way you handle this will also help to define you and the rest of your career. My family can only pray that you are as interested in upholding the law as you were when you made the decision to go into your profession.

I would like to meet with you.
I would like to know how to secure a grand jury investigation into our allegations.

We lost our home and it’s contents and our resolve will never waiver. Police actions against us were not only negligent, they were criminally negligent.
